Georgia’s reform of the law enforcement system is being carried out in

Eight representatives of the Georgian Ministry of Justice, the Georgian Parliament and the National Enforcement Bureau will spend one week in Germany, Bremen to deepen their knowledge about the German system of executing administrative and judicial decisions that are subject to administrative and civil law. The study tour is assisted by the Deutsche Gesellschaft fur Technische Zusammenarbeit (GTZ) – also known as German Technical Cooperation – and aims at enhancing the skills of the Georgian specialists. According to the GTZ representatives the skills gained by sharing the experience with the German colleagues will greatly benefit to the reform of law enforcement system in Georgia that has been long supported by the GTZ.
Significant changes in the Georgian Law on Enforcement went into force on October 1, 2008 in Georgia. According to the amendments, the enforcement of administrative and judicial decisions was assigned to a newly created Legal Entity of Public Law – the National Bureau of Enforcement (NBE). Except creating this Legal Entity of Public Law subjected to the Ministry of Justice, one other significant achievement is the introduction of a flat fee on percentage basis due to cover all expenditures of all necessary law enforcement procedures. Also, in about one year’s time a registry of debtors shall start to work. After the law, this shall be a database including all individuals or legal entities that do not honour debts within the terms defined by the court’s decision. The registry will be established under the National Bureau of Enforcement. Finally, the requirements for the pre-qualification of applicants on the position of bailiffs (enforcement officer) had been increased.
The Deutsche Gesellschaft fur Technische Zusammenarbeit (GTZ) GmbH has been supporting the reforms carried out by the Georgian government in the legal and judicial system since 1999. In the framework of the GTZ-project “Support to the legal and judicial system of Georgia”, one of the main aspects of cooperation with the Ministry of Justice in Georgia is the reform of the law enforcement system. The mutual aim is to establish a transparent and effective system of executing administrative and judicial decisions in the fields of administrative and civil law. During the time of cooperation between the Ministry of Justice and GTZ for the last 10 years numerous trainings and visits have been conducted in order to enhance the knowledge and to share the experience of the different specialists responsible for the law enforcement.
